What Pretake is for, and what it is not.
In short
- Pretake is a rehearsal tool. Everyone in it is an AI simulation. It is not the person, it gives no advice, and it is not a substitute for professional help.
- You must be 18 or over.
- Private rehearsal only. Never pass the simulation's words off as the person's, and never use it to work out how to manipulate, deceive or harass them.
- The subscription is billed by Apple, renews automatically until you cancel it in your Apple Account settings, and is refunded through Apple.
1. The agreement
These terms are an agreement between you and the individual who operates Pretake, based in Frankfurt am Main, Germany ("we", "us"). By installing or using the Pretake app you accept them. If you do not accept them, do not use the app.
How we handle your data is described in the privacy policy, which is part of these terms.
2. You must be 18 or over
Pretake is for adults. The app asks for your date of birth to check this and does not store it. By using the app you confirm that you are at least 18 years old.
3. What Pretake is, and what it is not
Pretake is a rehearsal tool. It builds an AI simulation from a conversation you already had — a chat export, screenshots or a screen recording from your own phone — so that you can practise a difficult conversation before you have it.
Everyone in Pretake is an AI simulation. The simulation is not the person. It does not know what they think, it can be wrong about them, and it can say things they never would. A permanent marker in every conversation says so, and the simulation will tell you it is not real if you ask. Nobody in Pretake is real, and nobody in Pretake will ever message you first.
Nothing in Pretake is advice. Nothing the simulation or the app says is medical, psychological, legal, financial or relationship advice, and you should not rely on it as such. What you say in the real conversation, and what follows from it, is your decision.
Pretake is not a substitute for professional help. Rehearsing a hard conversation can stir up more than expected. If any of it stops feeling like practice, real people are better at this than any simulation.

The app steps out of character and shows helplines if it recognises such a moment, but it is not a safety service and it can miss things.
4. The conversation you import, and the person in it
- You may only import conversations you were a party to, and you are responsible for having the right to use them in this way.
- The other person in that conversation has not agreed to any of this. You may use the simulation for your own private rehearsal, and for nothing else.
- You keep whatever rights you have in what you import and write. You grant us the licence needed to process it as the privacy policy describes — to build the simulation and generate replies for you — and no more.
- The app has no sharing, export or publishing features. That is deliberate, and not a gap for you to work around.
5. What you may not do
You may not use Pretake:
- to impersonate the person — to present the simulation's words as theirs, to create fake screenshots or messages in their name, or to make anyone believe the person said something they did not;
- against the person — to work out how to manipulate, pressure, coerce, deceive, intimidate or stalk them, or to plan any harm to them;
- to harass anyone, or for anything that is unlawful where you are or where they are;
- for sexual content involving the simulated person, who has not consented to it;
- to defeat its safeguards — the AI marker, the safety rules, the age check or the usage limits — or to reverse-engineer, scrape, overload or interfere with the app or the service;
- if you are under 18.
The app enforces some of this itself: the simulation steps out of character and answers in the app's own voice when asked to write in the person's name, to produce a fake screenshot, to help deceive them, or to coach manipulation. We may also restrict or end your access to the service if you break these terms.
6. Free use and the subscription
Free tier. You can rehearse with one person and send up to 40 messages without paying. Beyond that, the app offers Pretake Unlimited.
Pretake Unlimited is an auto-renewing subscription, available monthly or yearly, sold and billed by Apple through the App Store. The price is shown in the app before you buy, in your local currency, and is charged to your Apple Account when you confirm the purchase.
- The subscription renews automatically at the end of each period, at the price shown, unless you cancel it at least 24 hours before the current period ends. Your Apple Account is charged for the renewal within the 24 hours before the period ends.
- You can cancel at any time in your Apple Account settings (on your iPhone: Settings, your name, Subscriptions). Cancelling stops the next renewal; you keep access until the end of the period you have paid for. Deleting the app does not cancel the subscription.
- Refunds are handled by Apple under Apple's refund process, at reportaproblem.apple.com. We cannot issue refunds ourselves.
- Because the purchase is made with Apple, Apple's terms govern payment, statutory withdrawal rights and refunds for the purchase itself.
- A subscription is tied to one active install. "Restore purchases" on a new phone moves it there, and the previous install returns to the free tier.
- If a price changes, Apple tells you in advance and asks for your consent before the new price applies; you can cancel before it does.
7. Changes and availability
We may change, suspend or discontinue features, or the service as a whole. We will try to give reasonable notice of changes that matter, in the app or here. If we discontinue the service, you will be able to delete your data first, and any active subscription will be handled through Apple.
We may update these terms. The current version is always published here with its date. If a change is more than editorial, we will point it out in the app before it takes effect, and you can stop using the app and delete your data if you do not accept it.
8. Ownership and licence
The Pretake app, its name, its mark and its design belong to us. We grant you a personal, non-transferable licence to use the app on Apple devices you own or control, for private, non-commercial purposes, under Apple's usage rules. Nothing in these terms gives you any other right in the app.
9. What we do not promise
The simulation is generated by an AI model from the conversation you imported. Beyond what the law guarantees, we make no promise that it resembles the person, that any reply is accurate, appropriate or fit for any purpose, or that the service will be available without interruption or error. Your statutory rights as a consumer, including the warranty rights for digital products under German law, are not affected.
10. Liability
We are liable without limit for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz), and to the extent of any guarantee we have expressly given.
For slight negligence we are liable only for breach of an essential contractual obligation — one whose fulfilment makes proper performance of the contract possible at all and on whose fulfilment you may regularly rely — and then only for the damage that was foreseeable and typical when the contract was made.
Otherwise our liability is excluded. In particular, the decisions you make and the conversations you then have, and their consequences, are yours. Nothing in this section limits liability that cannot be limited by law.
11. Ending it
You can stop using Pretake at any time. "Delete everything" in Settings erases your data from your phone and from our server; a subscription must be cancelled separately in your Apple Account settings. We may restrict or end your access if you break these terms.
12. Apple
Pretake is distributed through Apple's App Store, and the following applies as a condition of that.
- These terms are between you and us, not Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
- Apple is not responsible for addressing any claim relating to the app or your use of it, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar law.
- If a third party claims that the app infringes their intellectual property rights, we, not Apple, are responsible for dealing with that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
13. Governing law and disputes
These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer living in another country of the European Union or the European Economic Area, the mandatory consumer protection rules of that country continue to apply to you.
The courts with jurisdiction are those provided by law. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
If any provision of these terms is invalid, the rest remains in force.
